The terms and conditions of Twitter should be included in the terms and conditions of this competition;
Dates and times within which the competition is to be run;
Describe what the contestant would need to do in order to qualify as an entrant to the competition;
Entries should be subject to the following conditions:
may not contain profanity or images in poor taste;
may not contain text images;
may not contain third party IP (i.e. no brand images, cartoons, logos, music controlled by third parties etc.); and
may not contain personally identifiable information; i.e. photos with addresses, schools, your hometown, telephone numbers, etc.
It needs to state the territory within which the competition applies.
If the entrant is under 18 years old, they must ask the permission of a parent or guardian before entering the Prize Draw and sending the Entry.
Texx should reserve the right to cancel the competition or amend the Terms and Conditions without notice in the event of circumstances outside its control.
By entering the Contestant should warrant and represent that their Entry does not and shall not contain any material that, inTexx’s sole discretion (including but not limited to): (i) impersonates any person or entity, or falsely states or otherwise misrepresents their affiliation with a person or entity, without such person or entity’s prior written consent; (ii) constitutes personally identifying information or other personal or identifying information about them or any individual; (iii) is false, misleading, scandalous, offensive, violent, unlawful, defamatory, libellous, fraudulent, tortuous or threatening; (iv) encourages conduct that could be considered a criminal offense, could give rise to criminal or civil liability, or could violate any law, or that could otherwise be considered inappropriate; (v) constitute a virus or computer code, file or program of any kind that is harmful or invasive or may, or is intended to damage or hijack the operation of, or to monitor the use of, Texx or any hardware, software, or equipment; (vi) constitutes any advertising, promotional material, or other form of solicitation; or (vii) constitutes any non-public information about a company.
How and when entrants will be notified should they win.
Entrants are solely responsible for the content of any material posted, and any consequences of the further publication of such by Texx. Entrant warrants and represents that they are the owner and originator of the content in the Entry. Texx shall have no liability whatsoever and howsoever arising from their Entry or your material submitted. The Entrant waive any right to privacy and any right including “moral right” to inspect or approve uses, information provided or to be compensated for any such uses.
Entries that are incorrect or incomplete should be void. No refund should be made for the cost of any Entry. Texx may refuse to award the Opportunity, or withdraw the Opportunity, in the event of the Entrant’s fraud, dishonesty or non-entitlement under the Rules.
Texx should assume no responsibility for damages, losses and/or injuries that may result from the Entry in the Competition and/or the Entrant’s acceptance of the competition and/or their participation in the Competition, provided that nothing in the Rules shall exclude or limit Texx’s liability for death or personal injury caused by their staff or supplier’s negligence or for fraud.
Entrant should agree to release and hold harmless Texx, its parent companies, affiliates, subsidiaries, divisions, advertising and promotion agencies and its respective employees, officers, directors, agents, representatives, shareholders and competition’ partners (collectively, the “Releasees”) from any claims, actions, injury, loss or damages of any kind, including but not limited to, any damage to the entrant’s or any other person’s computer relating to or resulting from participation in, or downloading of any materials or software in connection with, this competition, personal injury or death (except for liability for death, personal injury and damage or loss caused by negligence byTexx, which is not excluded) resulting from participating in this competition or from the acceptance, possession, or use or misuse of any prizes awarded or participation in any competition-related activity.
